TRANSMISSION SHIFTING WITHOUT CLUTCH ACTIVATED

Hey guys, I've been working on a rephased project for quite a while now and have gotten to know her pretty well. Bikes been basically torn down to nothing and rebuilt, ( i've even re-soldered the coil driver on my pamco system) anyway, my issue is my transmission is able to shift without the clutch. I'm talking even with the left side cover off she'll shift. At first thought it was the worm drive but like i said took the whole left side cover off and still she shifts. I checked the right side star wheel to make sure my shift lever was in the correct position and it is ( exactly equidistant on star wheel ).......Yes the dot on the clutch basket is lined up. the clutch springs and plates are brand new...... any ideas as to what this could be? how is there pressure on the clutch plates with nothing pushing against it?
 
Most bikes that I've had could be upshifted without using the clutch while riding. We called that "speed shifting". Not exactly the same thing but...…

yeah this happens while the bike is stationary on the ground not running or moving. is this still normal? i did notice that it wont shift into first, only 2-5

If you are riding along the road and it "automatically" shifts gear by itself, it is because of a small spring.
Happened when my TX was new.
 
Does it shift without you touching the gear shift? If you look in the area of the star wheel behind the clutch basket there will be 2 springs. Usually it is the top spring that breaks and then the star wheel does not lock into place with that big washer looking roller attached to its left:

The lower spring on the selector arm may also be broken.
