I bought a pair of shocks from yamahaxs650.com. They do not fit unless I have them upside down and then they need a spacer or shorter stud. What does everyone think?

The way they are mounted is correct (nitrogen can at the top) although most mount em with the can at the back.

The pics of the OP's shocks make me wonder. 99% sure they are Chinese made. And I have seen a video where a guy just cuts off the "reservoir" on a very similar looking shock with a hacksaw. And finds it is a solid casting. No bore for oil or gas to flow through. Obviously I may be wrong regarding these though. Just a thought..

And, regarding up/down. Oem shocks from the 70s were rod up, due to the hydraulic design. Slightly more modern gas or emulsion shocks should be rod down, to minimize unsprung weight.
