What if your medical treatment was possibly killing you, and nobody told you?

Thank you guys, but last night things changed. I woke up to have a pee and couldn't keep my balance - Labyrinthitis. Now I can't go bike riding. I hope it passes in a few days. Having a shower this morning was tricky trying not to fall over bending to pick up the soap.......

Edit: My son came home today. He is a Doctor in a Hospital in North Wales so showed me some exercises to help recovery.
I hope it passes too, Paul !

Sure Jeff. I'll even fwd it to you if you pm me your email. Here's the cut and paste version.

I think that this notice is confusing. It doesn't really solidly place the responsibility of replacement on the supplier, because in the second part it refers to the manufacturer.
Today I'm going to call the New York State Attorney General's office for clarification.

> This morning I formally opened a case with Medicare which states, "My DME is refusing to replace my CPAP machine". They are going to have a Medicare investigator call me.

> I just got off the phone with the Director of AdaptHealth, my DME. It was a 25 minute call; In brief, this is how it went: I pointed out that The Federal Government (Medicare) is telling me that you (the DME) is responsible for replacement. She said that "in this case" the manufacturer is. I asked what "this case" means. She said if one machine breaks, we replace it, but with this multiple failure, we can't handle it. I jumped on that; I said that it appears that your company has disavowed responsibility because "its just too much work and cost, which is no excuse". I said that if a young couple wanted a child and instead had quintuplets, we wouldn't let them just drop the kids at Social Services because they "couldn't handle it". I gave her 3 more examples of moral equivalence. I said that companies can't shift responsibility to someone else just because they were financially overwhelmed. I referred to this as "corporate moral corruption". FInally, I returned to the fact that Medicare and Adapt health appear to disagree on who is responsible. I said, "Someone is wrong, either you or The Federal Government", to which she responded, "I think you're trying to trap me!" and "I'm going to stop commenting on this issue". However, she did address a technical/staffing complaint I had, and she's going to call me back on monday. I ended with, "I'm dissatisfied, and I consider this an open matter".

> I started a complaint with the Compliance Department of AdaptHealth which addresses poor performance by their employees.

Yamadude, Would you care to give the name of your DME, either here or in "Start a Conversation"?
Ken, It is AdaptHealth, aka Halperin. It used to be Franciscans.
I'm thinking of changing to Nunn's in 'Cuse when this is over.
What is your DME?

Nunn's, started out with Discount Medical Equipment. Changed because we were having problems mostly with communications between us and them. Nunn's while not perfect seems a bit better. They will put you on a schedule and they email you to tell you that you need to order supplies.

Like a lot of things and places with Covid restrictions things can get a bit confusing if you want or need to make changes to your supplies.

Oh yes, the class action lawsuits emerged quickly back in July.
The unusual circumstance here is that the product manufacturer has already admitted their guilt. There is substantial evidence of the degradation of the internal foam sound baffle.
They have applied to the FDA for approval of their plan to fix the machines, a sly move. Any delay in the start to their fix plan will probably be blamed on the FDA.

In fact, I have found black particles in my machine's air chamber. I collected them and saved them.

However, back on 8/27 I received my first in-line filters in the mail, which I installed to catch any more particles.
And I managed to convince my sleep doctor's medical staff to join me in analyzing the impact of the in line filter on cmH2O and AHI (most relevant to the ADAP vs. CPAP machines) after a two week period, at which time they will discuss the findings in their staff meeting.

My insurance company has denied my request for a replacement of my machine, no surprise, so I am stuck with it.
Excellus BC is denying all requests for replacement.

Dude, this is who I use and they are awesome. Call me when I have supplies ready and no pressure. Also a very caring staff. cpapsuppliesplus.net I think if your machine is two years old it’s supposed to be replaced? Not sure about that one as I think I went about 4.

You’ve gotta love class action lawsuits, the companies may very well wind up settling in the end, but the only ones to ever see any money will be the lawyers.
Because the settlement is spread among so many. Without the lawyers, you get nothing, zero, nada. AND, no accountability.

you make the day shift, it's all about medical problems and procedures.
I think that this CPAP medical story is very much about Human Values and where they fit into today's societal Moral Priorities.
In my many communications with the Director of AdaptHealth I kept pointing out that she was clueless as to this question.
In my last message I told her that I thought that this is why she's such a failure as a Director.

You just said a mouthful, and I'm going to leave it at that.

Excellus actualllly settled a major class action lawsuit recently, which I was a part of. I was told I had about $30 coming to me. Excellus decided to get ahead of the payout and sent all of us parties a small check. I got $63.

My wife got a check last week for $183 in a settled class action law suite. We're out over $25,000, but so it goes. That's a lot of motorcycle parts!

A piece of good news for us CPAP users: The FDA has just approved the The Philips Fix-It Plan.
Wonder how it's going to work. Is Philips going to contact those who registered for the reacll directly or will it have to go through the DME the machine was purchased through?

I have one of the Philips machines that is included in the recall but have been put on a different machine for unrelated reasons. Just wondering if I should see about getting the recall done on this machine and see if there is a market for a used machine or maybe some place I could donate it?
