Oh yes, the class action lawsuits emerged quickly back in July.
The unusual circumstance here is that the product manufacturer has already admitted their guilt. There is substantial evidence of the degradation of the internal foam sound baffle.
They have applied to the FDA for approval of their plan to fix the machines, a sly move. Any delay in the start to their fix plan will probably be blamed on the FDA.
In fact, I have found black particles in my machine's air chamber. I collected them and saved them.
However, back on 8/27 I received my first in-line filters in the mail, which I installed to catch any more particles.
And I managed to convince my sleep doctor's medical staff to join me in analyzing the impact of the in line filter on cmH2O and AHI (most relevant to the ADAP vs. CPAP machines) after a two week period, at which time they will discuss the findings in their staff meeting.
My insurance company has denied my request for a replacement of my machine, no surprise, so I am stuck with it.
Excellus BC is denying all requests for replacement.
